Bextree is a marketplace that connects buyers and sellers of ownership rights to on-chain assets — vesting and lock positions (for example, Streamflow or Jupiter Lock contracts) and liquidity provider (LP) positions from protocols like Orca, Raydium, and Meteora DAMM v2 NFT Positions. Bextree facilitates the auction and settlement of those rights. It is not a party to the underlying asset or contract itself, and it does not issue, manage, or guarantee the assets being referenced.
1. Wallet-based access
Bextree does not use accounts, emails, or passwords. Access to the platform is through your Solana wallet. You are solely responsible for the security of your wallet, including your private keys and seed phrase. Bextree cannot recover a lost wallet, reverse a transaction, or restore access on your behalf. Any activity signed from your wallet is treated as authorized by you.
2. Bids are binding
Placing a bid in an auction is a commitment, not a casual expression of interest. If your bid wins, you are obligated to complete payment and settlement according to the terms of that auction. Do not bid amounts you are not prepared to pay.
3. Settlement bonds
Some assets — notably Streamflow and Jupiter Lock vesting and lock positions — cannot be held in escrow by Bextree ahead of time, because only the current holder is able to transfer them. For these listings, the seller posts a settlement bond as a condition of listing. If a seller fails to transfer the underlying asset to the winning buyer within the settlement window, the bond may be forfeited, in whole or in part, as compensation to the buyer. This is a real, active mechanic of the platform and not a hypothetical penalty — sellers should only list assets they are able and willing to transfer on time.
4. Fees
Bextree charges a platform fee only on successful settlements, calculated as a percentage of the final sale price. Placing a bid, being outbid, or participating in an auction that does not result in a sale never incurs a fee.
5. No guarantee of value
Bextree does not guarantee the value, performance, or future liquidity of any asset listed on the platform. Nothing on Bextree constitutes financial, investment, or legal advice. Digital assets are volatile and can lose some or all of their value. You bid and transact entirely at your own risk, and you are responsible for doing your own research before participating in any auction.
6. Changes to these terms
We may update these Terms of Service from time to time as the platform evolves. If we make material changes, we will make reasonable efforts to communicate them before the changes take effect. Continued use of Bextree after an update constitutes acceptance of the revised terms.
7. Governing law and dispute resolution
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or your use of Bextree will be resolved through final and binding arbitration on an individual basis, rather than in court, except that either party may bring an individual claim in small claims court. Arbitration is conducted individually — you agree to bring claims only in your individual capacity, not as a plaintiff or class member in any purported class or representative proceeding.
8. Not a securities offering
Bextree does not create, issue, sell, or manage the underlying vesting positions, lock contracts, or LP positions referenced in any listing, and takes no position on how any particular asset should be characterized under securities law in any jurisdiction. Nothing on Bextree is an offer or solicitation to buy or sell a security. You are responsible for determining whether your use of the platform, or any asset you bid on, complies with the laws that apply to you.
9. Eligibility and restricted persons
Bextree performs no identity verification — access is by wallet only. By using Bextree, you represent that you are not located in, organized in, or a resident of any country or region subject to comprehensive U.S. sanctions, and that you are not on any U.S. government list of prohibited or restricted parties (including OFAC's Specially Designated Nationals list). You further represent that using Bextree does not violate any law that applies to you, including any local restriction on accessing crypto-asset marketplaces. Bextree may restrict or deny access to any wallet at its discretion, including to comply with applicable law.
10. Disclaimer of warranties and limitation of liability
Bextree is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied. We do not warrant that the platform will be uninterrupted, error-free, or secure. To the fullest extent permitted by law, Bextree and its team are not liable for indirect, incidental, or consequential damages arising from your use of the platform, including losses related to smart contract behavior, network congestion, wallet compromise, or third-party protocol failures. This isn't meant to shift every risk onto you unfairly — it simply reflects that Bextree is a marketplace layer on top of infrastructure and assets it does not control.
